Pet Meds Express Loses Domain Dispute

1800PetMeds.com, an online pet medicine retail store, lost a domain dispute at the World Intellectual Property Organization. The dispute included a number of similar domain names, such as PetMedOutlet.com, registered by Joseph Brinton.

Brinton argued that the phrase “Pet Meds” was a general term not subject to trademark protection. Specifically, Brinton pointed to the fact that 1800PetMeds.com used the phrase in numerous contexts, many of which were non-trademark uses.

The organization determined that the registration of PetMedsOutlet.com was done in good faith and the phrase “pet meds,” was not protectable.

Domain Dispute Over www.goldman666.com

A blogger filed a lawsuit against financial giant Goldman Sacs over a domain name. The blogger filed the declaratory judgment asking the court to declare that he lawfully owns his blogs website address and that it does not infringe upon Goldman’s trade mark.

After Goldman accepted money from the federal government’s Troubled Asset Relief Program (TARP), the blogger started www.goldman666.com. The blogger used his website to criticize Goldman for is management, business practices, and for accepting TARP money.

Shortly thereafter, he received a letter from Goldman asking him to remove the blog. The blogger responded by filing the declaratory judgment action in a Florida federal court.
